SOCIAL NORMS FOR THE USE OF SOCIAL PROFILES OF FUNDACIÓN ALICIA KOPLOWITZ

Below you will find the social norms or general guidelines governing the relationship of FUNDACIÓN ALICIA KOPLOWITZ, with registered office in Madrid, Paseo Eduardo Dato n°18, Planta Baja 28010, Madrid, and the users of its profile on Facebook, YouTube, Instagram and/or LinkedIn (hereinafter, the profile, indistinctly).

ACCEPTANCE OF SOCIAL NORMS OF USE

By using our profiles, you agree to be bound by these social norms of use as well as all other applicable policies published by FUNDACIÓN ALICIA KOPLOWITZ and the owners of each one of the social networks: Facebook, YouTube, Instagram and/or LinkedIn. FUNDACIÓN ALICIA KOPLOWITZ may, at its discretion, publish norms on use and/or user content, which would apply to the use of our profiles without prejudice to the policies of each of the social networks on which each of the profiles owned by FUNDACIÓN ALICIA KOPLOWITZ are hosted. These terms are additional and do not override any other user-accepted terms.

The profiles are not intended for disclosing personal data or information through them. Any statements or publications made are subject to the conditions of use and privacy established by FUNDACIÓN ALICIA KOPLOWITZ and by the social network where the specific profile owned by FUNDACIÓN ALICIA KOPLOWITZ is hosted. FUNDACIÓN ALICIA KOPLOWITZ is not responsible for the actions, omissions, terms and privacy and security policies of each of the social networks: Facebook, YouTube, Instagram and/or LinkedIn.

 

PURPOSE

Participation in each profile is voluntary. FUNDACIÓN ALICIA KOPLOWITZ promotes and thanks all users for using these spaces and for helping to promote them through their comments, images and/or participation.

FUNDACIÓN ALICIA KOPLOWITZ has created these spaces for the purposes of information and to disseminate its activity for personal and non-commercial use by users. Therefore, if you do not agree with the social norms established by FUNDACIÓN ALICIA KOPLOWITZ, please do not participate in these spaces.

USER PARTICIPATION

FUNDACIÓN ALICIA KOPLOWITZ firmly believes in freedom of expression and has conceived these spaces as a forum for opinion and the exchange of information and user comments. The opinions and comments issued by users in these spaces do not directly identify with or are linked to those of FUNDACIÓN ALICIA KOPLOWITZ. Notwithstanding the above, in order to guarantee that these are an area of coexistence of opinions in which the rights of all users are respected, the user must respect the following social norms established and agreed below:

  1. We all have the right to freedom of expression, but remember that your rights end where other users’ rights begin. Respect comments and those who provide them.
  2. Consequently, comments that are offensive, insulting or in any way violate the right to honour of any user, entity, organisation or FUNDACIÓN ALICIA KOPLOWITZ are not permitted.
  3. Nor is it permitted to use these spaces to spread political, racist or xenophobic ideas.
  4. Comments intended to disqualify, offend or denigrate any other comment or news will not be permitted.
  5. Comments that are untruthful, provide erroneous information or attempt to mislead other users will not be permitted.
  6. Content containing pornographic or sexual material or comments of this nature will not be accepted.
  7. These spaces cannot be used to threaten or coerce.
  8. These spaces will not be used to reveal intimate life data of third parties, even if they are your family or friends.
  9. Comments promoting products and/or business activities are not permitted. In this regard, it is strictly forbidden to use these spaces for publishing information on third-party products or for publishing links redirecting to third-party websites outside FUNDACIÓN ALICIA KOPLOWITZ that are contrary to the principles of FUNDACIÓN ALICIA KOPLOWITZ.
  10. Nor is it possible to use these spaces for sending spam.
  11. If you are not within the age limit established by the social network to which the social profiles owned by FUNDACIÓN ALICIA KOPLOWITZ belong, you must immediately leave these spaces.
  12. Comments that violate the law, the rights of users, and obscene, violent comments and the sending of files that violate morality, the spirit of the brand or that may harm the sensitivity of other users will not be allowed.

USER CONTENT

With regard to the content posted by the user, he/she guarantees FUNDACIÓN ALICIA KOPLOWITZ that (i) he/she holds all the rights necessary to own and make use of it; and (ii) the content does not infringe the image, honour, privacy, intellectual and industrial property, know-how or any right owned by third parties, nor does it constitute unfair competition.

As a result, the user is solely and exclusively responsible for the uploaded and published content and undertakes to hold FUNDACIÓN ALICIA KOPLOWITZ harmless against any judicial or extrajudicial claim by third parties based on the allegation that the content infringes rights of image, honour, privacy, intellectual and industrial property, know-how or other rights owned by third parties and/or constitutes unfair competition.

The user may contact and inform FUNDACION ALICIA KOPLOWITZ by any means in the event of being cognisant of any infringement of the rights of a user or third parties.

 

INFRINGEMENT OF SOCIAL NORMS. RESPONSIBILITIES

FUNDACIÓN ALICIA KOPLOWITZ reserves the right to control, delete, remove any opinion or content that contravenes the aforementioned norms. FUNDACIÓN ALICIA KOPLOWITZ may thus correct any uses contrary to social norms in the event of any breach, deleting all comments or attached documents.

User comments or content are the user’s sole responsibility. Should the user’s posts, comments or content violate the rights of FUNDACIÓN ALICIA KOPLOWITZ, other users or third parties, the user shall be solely responsible under the terms set out in these social norms.

Failure to comply with the terms set out in these social norms may result in civil and criminal liability and significant financial penalties.

 

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

Any form of reproduction, distribution, public communication, transformation and, in general, any act of exploitation of all or part of the content (images, texts, designs, indexes, forms, etc.) comprising the profile, not expressly authorised in writing by FUNDACION ALICIA KOPLOWITZ, is prohibited.

Under no circumstances may the user exploit or use commercially, directly or indirectly, in whole or in part, any of the content (images, texts, designs, indexes, forms, etc.) that make up the profiles without prior written authorisation from FUNDACION ALICIA KOPLOWITZ.

All content, without exclusion and without limitation, forming part of the profile, i.e. information, articles, data, texts, logos, icons, images, photographs, page design and image (external appearance or “look and feel”), video files, audio files, databases, computer applications, are owned by FUNDACIÓN ALICIA KOPLOWITZ or are operated under a licence from third parties holding the intellectual and/or industrial property rights of the aforementioned content. These are protected by applicable intellectual and industrial property laws. All trademarks and logos of FUNDACIÓN ALICIA KOPLOWITZ referred to on the page are registered trademarks of FUNDACIÓN ALICIA KOPLOWITZ. FUNDACIÓN ALICIA KOPLOWITZ is not liable to third parties for any content posted by users and reserves the right to remove any content that contravenes the provisions of these social norms.

 

PERSONAL DATA

FUNDACIÓN ALICIA KOPLOWITZ, as Data Controller, informs you that the personal data provided by the user or that may be provided in the future will be processed to respond to or attend to any request made by the user to FUNDACIÓN ALICIA KOPLOWITZ through a direct message or in the profiles. The legal basis for processing is the legitimate interest of FUNDACIÓN ALICIA KOPLOWITZ in dealing with requests made by users. Users may exercise their rights of access, rectification, erasure, objection, restriction of processing, portability and lodge a complaint with the Spanish Data Protection Agency.

 

MODIFICATION OF SOCIAL NORMS

These social norms may be modified owing to changes in the characteristics and functionalities of the profiles as well as regulatory or technological changes. FUNDACIÓN ALICIA KOPLOWITZ reserves the right to update or modify these social norms at any time by publishing the revisions in the profiles themselves. Changes will be effective from the date of publication. The use of the profiles by the user after any changes constitutes acceptance of the revised social norms.

 

PARTIAL UNENFORCEABILITY

If any provision of these conditions is held to be null or invalid, the remaining provisions shall not be affected and the provision held to be null or invalid shall be replaced by a provision that is valid and most closely approximates the underlying purpose of the unenforceable provision.

 

JURISDICTION

The regulations in force shall determine the laws and jurisdiction that will govern the relationship between FUNDACIÓN ALICIA KOPLOWITZ and the user. This notwithstanding, in those cases where said regulations in force provide for the possibility of the parties submitting to a particular legal forum, FUNDACIÓN ALICIA KOPLOWITZ and the user, waiving any other legal forum to which they may be entitled, accept the jurisdiction of the Courts and Tribunals of the City of Madrid.
